Welcome to julian-fashion.com (the "Website"). Please read these General Terms and Conditions of Sale (the "Terms and Conditions") carefully before purchasing any products (the "Products") through the Website.

These Terms and Conditions govern the sale and purchase of Products through the Website and define the respective rights and obligations of you and Julian Fashion. If you require any assistance, please contact our Customer Care team using the details provided in the Contacts section of the Website.

You may download, save, or print a copy of these Terms and Conditions for your records.

The Products available on the Website are sold directly by Julian Fashion S.r.l., with its registered office at Via Santerno 23, 48015 Cervia (RA), Italy, REA no. RA-134694, VAT no. 01304480393.

1. APPLICABILITY AND LEGAL NOTES

1.1 By placing an order through the Website, you acknowledge that you have read, understood, and accepted these Terms and Conditions. If you do not agree to these Terms and Conditions, you will not be able to place an order.

1.2 We may update or amend these Terms and Conditions from time to time. The version applicable to your order is the one in effect at the time your order is placed.

1.3 If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

1.4 Orders may be placed in Italian, English, or German. In the event of any inconsistency between the different language versions, the English version shall prevail.

2. WHO CAN PLACE ORDERS

2.1 To place an order through the Website, you must be at least 18 years of age and act as a consumer, purchasing Products for personal use and not for any business, trade, or professional purpose.

2.2 You may place an order either by creating a registered account or by using the Quick Order option. In both cases, you must provide the information necessary for billing and delivery.

2.3 Before submitting your order, please ensure that all information provided is complete and accurate.

2.4 For information about your account and the processing of personal data, please refer to our Privacy Policy and Cookie Policy.

2.5 These Terms and Conditions apply exclusively to consumers. If you are purchasing Products for business, trade, or professional purposes, please contact our Customer Care team.

3. PLACING AN ORDER — ACCEPTANCE OF AN ORDER

3.1 Legally Binding Contract

By clicking the "Accept Terms and Conditions" button during checkout, you acknowledge that you have read, understood, and accepted these Terms and Conditions, thereby entering into a legally binding agreement with Julian Fashion.

Before placing your order, please carefully review all information provided during checkout, including delivery costs, your right of withdrawal, our Privacy Policy and Cookie Policy, and these Terms and Conditions.

3.2 Order Process

To place an order, follow the checkout process and review the Products, prices, applicable taxes, payment methods, shipping options, delivery times, and billing and delivery details.

Ensure that all information is complete and accurate, then click "Confirm and Pay." Promotional codes must be entered before confirming the order.

Once we receive your order, we will send an email acknowledging receipt, including a summary of your purchase and shipping details.

We carry out standard verification checks on electronic payments to help prevent fraud and ensure transaction security.

Your order will be accepted and the sales contract concluded only when the Products have been dispatched. You will then receive a shipment confirmation with tracking information and the estimated delivery date.

If you have placed an order in error, you may contact Customer Care to request cancellation. Cancellation cannot be guaranteed once processing or shipping has begun.

Julian Fashion reserves the right to refuse or cancel orders in accordance with these Terms and Conditions, including where Products are unavailable, displayed with an unintentional error, or subject to suspected fraudulent or unauthorized activity.

3.3 Email Communication

Please ensure that emails from Julian Fashion are not filtered into your spam or junk folder. We recommend adding our email address to your safe sender list or address book.

3.4 Order Tracking

Registered customers can track an order by logging into their account. Guest customers should contact Customer Care using the details in the Contacts section of the Website.

4. PRODUCT AVAILABILITY, LIMITATIONS AND ORDER CANCELLATION

4.1 Product Availability

All orders are subject to product availability. If one or more Products become unavailable before your order is processed, your order will be fulfilled only with the available Products. We will contact you regarding the changes and any applicable refund.

4.2 Sales to End Consumers

The Website is intended exclusively for sales to end consumers. The purchase of Products for resale is strictly prohibited. If Julian Fashion reasonably believes that an order has been placed for resale purposes, we reserve the right to limit purchases, refuse or cancel orders, and suspend or terminate the relevant customer account.

4.3 Right to Refuse or Cancel an Order

We reserve the right to refuse or cancel an order where, among other circumstances:

•        you do not meet the eligibility requirements;

•        the order originates from, or is to be delivered to, a country to which we do not ship;

•        we reasonably suspect fraudulent, unlawful, or unauthorized activity;

•        payment authorization fails or payment is not received within three business days;

•        a Product is displayed with incorrect pricing or other material errors; or

•        we reasonably suspect improper, deceptive, or fraudulent use, including resale through social media or online marketplaces.

4.4 Cancellation and Refunds

If an order that has already been paid for is refused or cancelled, Julian Fashion will refund all amounts paid for the cancelled Products using the original payment method, unless otherwise agreed. The time required for the refund to appear depends on the payment provider or financial institution.

5. PRODUCT CHARACTERISTICS

The characteristics, photographs, descriptions, and other information relating to Products are provided for informational purposes only. Photographs and colors may vary slightly due to device displays and screen settings.

Measurements, sizes, and dimensions provided in the Size Guide are intended as a general reference. Please contact Customer Care for further information before placing an order.

Julian Fashion is an authorized retailer of all brands available on the Website and in our boutiques. We guarantee the authenticity of every Product we sell.

6. PRICES AND SHIPPING COSTS

6.1 Prices and VAT

All prices are shown in Euros (€). For orders shipped within the European Union and the United Kingdom, prices include applicable VAT. For orders shipped outside the European Union, VAT is not included in displayed prices.

6.2 Currency and Exchange Rates

The Website operates in Euros (€). Estimated prices may be displayed in AUD, CAD, GBP, JPY, and USD for convenience. The final amount charged may vary due to exchange rates and fees applied by your payment provider or bank.

6.3 Duties and Customs Charges

DDP destinations: for orders shipped to the United Kingdom, United States, United Arab Emirates, and Australia, applicable duties and import taxes are included in the Product price. For orders shipped to the United States, Sales Tax is calculated separately at checkout and is refundable in the event of a return.

DDU destinations: for all other destinations, duties, taxes, and import charges are not included and must be paid by the recipient in accordance with local regulations. Julian Fashion has no control over customs procedures or local charges.

6.4 Shipping Methods

Shipping costs vary according to destination, shipping method, and order contents. Costs are calculated and displayed at checkout. Delivery times, shipping costs, and any free shipping thresholds for each country are shown on the Shipping page and at checkout.

Standard and Express Shipping are handled by international courier partners (DHL, FedEx, UPS), selected automatically based on the destination country. Express Shipping is always subject to an additional charge.

Fragrances and Personal Care Products: due to international regulations, these Products can only be shipped via BRT Standard Ground Shipping and cannot be shipped outside the European Union.

Additional shipping charges may apply for orders whose type, quantity, weight, dimensions, or destination exceed standard rates. If applicable, you may accept the additional cost or cancel your order for a full refund.

7. PROMOTIONAL CODES AND PROMOTIONS

Promotional codes are personal, non-transferable, and may only be used for purchases made through the Website. They must be applied during checkout before the order is completed.

If a code is forgotten, you may contact Customer Care immediately after placing the order, but application cannot be guaranteed. Once an order has been dispatched, no code or discount can be applied retrospectively.

Promotions are non-retroactive. Julian Fashion does not offer price adjustments or refunds of price differences after an order has been completed.

8. PAYMENTS

8.1 Accepted Payment Methods

We accept the following payment methods: Credit Card (Visa, Mastercard, and American Express) via Shopify Payments, Bank Transfer, PayPal, Wallet (Apple Pay and Google Pay), Klarna, Scalapay, and Julian Fashion Gift Card.

8.2 Payment Security

Payment transactions are processed through secure and encrypted systems. Julian Fashion does not store or have direct access to full payment details.

8.3 Ownership of Products

Regardless of the payment method selected, ownership of the Products remains with Julian Fashion until full payment has been received.

8.4 Credit Card Payments

Credit card payments are processed securely through Shopify Payments, our payment services provider. Your card details are entered directly into an encrypted, PCI-compliant checkout and are never accessible to Julian Fashion or stored on our servers.

8.5 Bank Transfer

If you choose to pay by bank transfer, bank details will be provided in the order confirmation email. Payment must be received in our bank account within three business days, unless otherwise agreed; failing this, the order may be cancelled.

8.6 PayPal, Wallet, Klarna and Scalapay

Payments made via PayPal, Wallet (Apple Pay and Google Pay), Klarna, and Scalapay are processed through the selected provider's own secure environment and are subject to that provider's terms and conditions.

8.7 Gift Card

The Julian Fashion Gift Card can be redeemed at checkout by entering the relevant code in the dedicated field. Gift Cards cannot be combined with cash refunds and cannot be reloaded once used.

Gift Cards are currently not valid for orders shipped to the United States, United Kingdom, Australia, and the United Arab Emirates.

9. SHIPPING, DELIVERY TIMES, AND DESTINATIONS

Orders are processed Monday to Friday, between 9:00 a.m. and 5:00 p.m. CET, excluding Italian public holidays. Processing may require up to 48 business hours.

Orders are dispatched within the applicable processing timeframe once payment has been authorized or received. Standard and Express Shipping refer to carrier transit time after dispatch and do not shorten order preparation time.

Delivery times are estimates beginning when the shipment confirmation email is sent. Sale periods, holidays, customs inspections, carrier delays, weather, and other circumstances beyond our reasonable control may affect delivery.

Certain Products may not be available for delivery to specific destinations due to customs regulations, legal restrictions, transportation requirements, or logistical constraints.

10. INSPECTION OF PRODUCTS UPON DELIVERY

Upon delivery, please inspect the Products and packaging. If the packaging appears damaged or the Products may have been damaged or tampered with, refuse delivery where possible and note the reason on the carrier's documentation.

Please notify Customer Care as soon as possible and provide clear photographs of the parcel, shipping label, packaging, and any visible damage.

11. RIGHT OF WITHDRAWAL AND RETURNS

11.1 Right of Withdrawal

If you are not completely satisfied with your purchase, you may exercise your statutory right of withdrawal by returning the Products within fourteen (14) days of receiving them, without providing any reason or incurring any penalty.

11.2 Conditions and Exclusions

Products must be returned unused, unwashed, unaltered, and complete with original packaging, tags, accessories, authenticity tags, and security seals. Footwear soles must show no signs of wear.

The right of withdrawal does not apply to the following Products:

•        made-to-measure, customized, or personalized Products;

•        Products damaged after delivery; and

•        sealed Products unsuitable for return for health or hygiene reasons once unsealed, including underwear and swimwear where applicable.

11.3 Return Procedure

To request a return, log in to your account and access the Orders section. The request must be completed within fourteen (14) days of receiving the Products. Returned Products must be handed to the designated courier within five (5) days of receiving the return confirmation.

11.4 Exchanges

Julian Fashion does not offer direct exchanges. Please return the original Product and place a new order.

11.5 Return Shipping Costs

Return shipping costs are the customer's responsibility: Italy €10 — European Union €20 — United Kingdom £30 — United States $30 — United Arab Emirates $70 — Australia A$90 — Rest of the World €45 + applicable customs charges.

11.6 Refunds

Once returned Products have been received and inspected, approved refunds are processed within ten working days using the original payment method.

Refunds cover only the value of the returned Products. For orders shipped to DDP destinations (United Kingdom, United States, United Arab Emirates, and Australia), duties and taxes paid at checkout are refunded together with the value of the Products. For the United States, Sales Tax is also refunded. Original shipping costs are not refundable. For all other destinations, duties and taxes are paid by the customer directly to customs or the carrier and are not refundable by Julian Fashion.

12. LEGAL WARRANTY

All Products purchased through the Website are covered by the legal warranty of conformity under applicable consumer protection laws for two years from delivery.

To make a warranty claim, notify Julian Fashion within two months of discovering the lack of conformity by contacting Customer Care. We will provide instructions for returning the Product for inspection.

Where appropriate, the Product may be repaired or replaced. If neither is possible or appropriate, you may be entitled to a refund or another remedy required by applicable law.

The legal warranty does not cover accidental damage, improper or negligent use, failure to follow care instructions, unauthorized repairs or modifications, or normal wear and tear.

13. INTELLECTUAL PROPERTY

All content available on the Website, including trademarks, logos, product names, text, images, photographs, videos, graphics, designs, layouts, software, and other materials, is owned by or licensed to Julian Fashion and protected by applicable intellectual property laws.

You may access and use the Website solely for personal, non-commercial use. Except as permitted by law or with prior written consent, you may not reproduce, copy, modify, distribute, publish, transmit, display, sell, create derivative works from, or otherwise exploit Website content.

14. EVENTS BEYOND OUR REASONABLE CONTROL

Julian Fashion shall not be liable for delay or failure to perform obligations where caused by events beyond its reasonable control, including war, armed conflict, terrorism, fire, earthquakes, floods, severe weather, strikes, epidemics, transportation or communication interruptions, energy shortages, acts of government, or other unforeseeable events.

If such an event affects the processing or delivery of an order, our obligations will be suspended for its duration. Where reasonably possible, we will notify you by email.

15. PRIVACY AND COOKIE POLICY

For information about how Julian Fashion collects, uses, stores, and otherwise processes personal data, and how the Website uses cookies and similar technologies, please refer to our Privacy Policy and Cookie Policy available on the Website.

16. GOVERNING LAW AND DISPUTE RESOLUTION

16.1 Governing Law

These Terms and Conditions and any sales contract concluded through the Website are governed by the laws of Italy, without prejudice to mandatory consumer protection laws applicable in your country of residence.

16.2 Jurisdiction

Any dispute shall be subject to the jurisdiction of the competent court of your place of residence or domicile where required by applicable consumer protection laws. Where permitted, you may alternatively choose to bring proceedings before the Court of Ravenna, Italy.

16.3 Online Dispute Resolution

Residents of a Member State of the European Union, or of Norway, Iceland, or Liechtenstein, may also have access to the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.
