1. Data Controller

The Controller of the Personal Data processed through the Site, for the purposes described below, is Julian Fashion S.r.l., with registered office at Via Santerno 23, 48015 Cervia (RA), Italy, VAT no. 01304480393 (hereinafter “Julian Fashion” or the “Controller”).

For any matter relating to the processing of your Personal Data and to exercise your rights, you can write to privacy@julian-fashion.com.

2. Personal Data processed

While you browse the Site and use the Services offered, the Controller will process information about you that may be collected automatically during your browsing or provided directly by you (for example when you create an account, make a purchase, subscribe to the newsletter, contact us or use the customer service chat).

In particular, the Personal Data processed through the Site are:

a) Data for creating and managing your personal account

The Services include the option to create a personal account. You log in by entering your email address, to which a one-time verification code (OTP) is sent, with no need for a password. Within your account you can enter and store further data, such as first name, last name, shipping and billing addresses and phone number, and manage your communication preferences. Your order history and related information are also available in your account.

The Site also allows you to log in or save your details for a faster checkout through the “Shop” account offered by Shopify. In this case, the relationship relating to the Shop account is directly between you and Shopify, which processes the related data as an independent controller in accordance with its own terms and privacy policy, available when you activate the service.

b) Data needed to purchase products

You can complete your purchase either by logging in to your account or as a guest (without registering). During the purchase process you will be asked for the data needed to manage the order, such as first name, last name, email address, shipping and billing address, phone number, and information relating to your chosen payment method. Payment card data are processed directly by the payment service providers through encrypted channels and are not stored by Julian Fashion.

If you choose an instalment or deferred payment method, the relevant provider will process your data as an independent controller, including for the checks within its remit, and will provide you with its own privacy notice during the payment process.

For orders shipped to the United States, the United Kingdom, Australia and the United Arab Emirates, the sale is carried out by a partner specialising in international e-commerce, based in the European Union, which acts as the seller of the transaction (merchant of record). The partner’s name and a link to its privacy notice are shown on the checkout page before the order is confirmed. In these cases, the order data are disclosed to the partner, while payment data are collected directly by the partner and by the payment service providers it uses. The partner processes the data as an independent controller for the purposes connected with the sale (including payment, fraud prevention, tax and customs obligations, shipping, returns and refunds), as described in its own privacy notice. For the operation of the partner’s services integrated into the checkout page and the exchange of data needed to fulfil the order, for the related reporting and analysis activities, for customer service and for recording any marketing consent given at checkout, Julian Fashion and the partner act as joint controllers (Article 26 of the Regulation), on the basis of an agreement defining their respective responsibilities, the essence of which you may request at the address indicated in section 1. For this processing you may exercise your rights against each of the joint controllers: against Julian Fashion at the address indicated in section 1, and against the partner at the contact details given in its privacy notice.

Further Personal Data may be collected while managing the relationship after the purchase, for example in the case of support requests, returns, refunds or complaints.

c) Data provided through the contact form, email and customer service chat

You can contact our customer service through the form in the “Help & Contact” section, the email address shown in the same section, the WhatsApp channel (section 2, letter e) and the chat on the Site. The contact form will ask you to enter your first name, last name, email address, phone number (optional, used solely to reply to you via WhatsApp), the reason for your request and its text; through the chat you can also attach files or images (for example a photo of a product you received). We will process any further information you choose to share with us when describing your request. How the chat works, including its use of an AI-based virtual assistant, is described in section 4.

In sections with free-text fields, please do not send us Personal Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, or data concerning health, sex life or sexual orientation. If you intend to share Personal Data of other people with us, you act as an independent controller and assume all the duties and obligations under applicable law, including verifying that there is an appropriate legal basis for the processing.

d) Data for subscribing to the newsletter and promotional communications

You can subscribe to the newsletter through the dedicated forms on the Site (sign-up pop-up, footer section and dedicated checkbox on the checkout page). You will be asked for your email address, your country and the language in which you wish to receive communications and, optionally, your first name, last name and date of birth, the latter so that we can offer you special initiatives on your birthday.

e) Data collected through the WhatsApp channel

In the “Help & Contact” section and in the footer there is a link to the WhatsApp instant messaging service, operated by Meta Platforms Ireland Limited, which you can use to send messages to our customer service and request commercial information (orders, shipping, returns, etc.). Using this channel involves the processing of data by the service operator, which processes them in accordance with its own terms and privacy policy, available at https://www.whatsapp.com/legal/privacy-policy. The messages you send us are handled by our customer service through the customer service platform referred to in section 5, letter b). Any Personal Data included in the communications may be transferred to countries outside the European Economic Area, as specified in the service’s privacy policy.

f) Data relating to unsolicited job applications

In the “Work with us” section you can send your application by email to the dedicated address. In this case, we will process the data contained in your CV and cover message (personal and contact details, education, work experience and any other information you choose to provide). Please do not include special categories of data in your CV, except those whose disclosure is required by law (for example, membership of protected categories). At the first useful contact you will be given a specific privacy notice relating to recruitment.

g) Links to social networks

The Site contains links to Julian Fashion’s profiles on the main social networks (for example Facebook, Instagram, YouTube, TikTok, LinkedIn and Pinterest). The link alone does not transmit your data to the platform operators until you click on the relevant icon: once you reach the platform, the processing of your data is governed by the operator’s privacy policy. Any social components embedded in the Site’s pages are activated only with your express consent given through the cookie banner.

h) Browsing data and cookies

The IT systems and software procedures used to operate the Site acquire, in the course of their normal operation, certain Personal Data whose transmission is implicit in the use of Internet communication protocols. This category includes IP addresses, device identifiers, browser and operating system type, the URLs of the resources requested, the time of the request and other parameters relating to the user’s IT environment, as well as information on your interaction with the Site (pages visited, products viewed or added to the cart). These data are processed to ensure the proper functioning and security of the Site and, with your consent where required, for statistical and marketing purposes. Information on the use of cookies and other tracking technologies is available in the Cookie Policy, which we invite you to read carefully.

The Controller will process your Personal Data for the purposes described below.

a) Provision of the Services and sale of products: your Data will be processed to carry out all activities connected with the purchase of products and to assist you before, during and after a purchase: in particular, to create and manage your account, verify your identity when you log in, complete the order, manage payment, shipping and delivery of the products, manage returns, exchanges, refunds and the exercise of the right of withdrawal, allow you to view your purchase history, and send you service communications relating to your account and orders (for example order confirmations and shipping updates). This purpose also includes replying to the requests you send us through the contact form, email or chat. The legal basis for the processing is the performance of a contract to which you are a party or of pre-contractual measures taken at your request (Article 6(1)(b) of the Regulation). Providing the data marked as mandatory is necessary: without them, it will not be possible to process the order or request.

b) Soft spam: if you have purchased products sold by Julian Fashion through the Site, the Controller may use the email address you provided at the time of purchase to send you promotional communications about products similar to those purchased, even without your specific consent, as permitted by Article 130(4) of the Privacy Code. The legal basis is the Controller’s legitimate interest (Article 6(1)(f) of the Regulation). You can object to this processing at any time, free of charge and without giving reasons, by clicking the unsubscribe link at the bottom of each email or by writing to the address indicated in section 1.

c) Marketing: only if you have given specific consent, through the dedicated checkbox in the sign-up forms or on the checkout page, will your Data be processed to send you the newsletter and informational, promotional and commercial communications about Julian Fashion’s products, services, initiatives and events (including on your birthday, if you have given us your date of birth), as well as for market research and customer satisfaction surveys through questionnaires and polls. These communications may be sent by automated means of contact (email). Any benefit reserved for new subscribers (for example a discount on the first order) is linked exclusively to subscribing to the newsletter and does not require consent to profiling. The legal basis for the processing is your consent (Article 6(1)(a) of the Regulation; Article 130 of the Privacy Code). Consent is optional: not giving it does not in any way affect your ability to purchase on the Site. You can withdraw it at any time, including selectively for individual channels, by clicking the unsubscribe link in each email or by writing to clientservices@julian-fashion.com.

d) Profiling: only if you have given specific consent, separate from consent to marketing, may your Data be used to analyse your preferences and purchasing habits and send you personalised communications and offers that are more relevant and less intrusive. This may be done both by processing the Data you provide directly or that are generated by your interaction with the Services (for example products purchased, viewed or added to the cart, interactions with the communications received, country, gender preference), and through profiling cookies and other tracking tools, where you have accepted them through the cookie banner. This purpose also includes reminders about products left in your cart. In addition, through remarketing and behavioural targeting services provided by third parties, Julian Fashion optimises its advertisements on other websites and platforms based on your browsing on the Site, always subject to your consent to the relevant cookies. Profiling does not involve decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you. The legal basis is your consent (Article 6(1)(a) of the Regulation), which can be withdrawn at any time without consequences for the purchase of products.

e) Review requests: after a purchase we may send you an email inviting you to leave a review on Julian Fashion’s page on an independent review platform. To send it we use your name and email address; no data are disclosed to the platform, which you will reach only if you decide to follow the link. The legal basis is the Controller’s legitimate interest in gathering feedback from its customers and improving its services (Article 6(1)(f) of the Regulation). Publishing a review is always your free choice and takes place under the platform’s terms. You can object at any time, without giving reasons, to receiving invitations, via the link in each invitation or by writing to the address indicated in section 1.

f) Recruitment: the data contained in unsolicited applications are processed to assess your profile in relation to any open or future positions and, where appropriate, to contact you. The legal basis is the performance of pre-contractual measures taken at your request (Article 6(1)(b) of the Regulation); pursuant to Article 111-bis of the Privacy Code, consent is not required for the processing of data contained in spontaneously submitted CVs.

g) Legal obligations: your Data may be processed to comply with obligations under national or European Union laws, regulations and rules (for example on tax, accounting and consumer protection), or with instructions issued by the competent Authorities. The legal basis is compliance with a legal obligation to which the Controller is subject (Article 6(1)(c) of the Regulation).

h) Security, fraud prevention and protection of rights: your Data may be processed to ensure the security of the Site and the Services, to prevent and detect anomalies, fraudulent activities and abuse in the use of the Site, payment methods and the returns procedure, and to establish, exercise or defend a right of the Controller in or out of court. The legal basis is the Controller’s legitimate interest (Article 6(1)(f) of the Regulation). You can object to this processing on grounds relating to your particular situation, as indicated in section 8.

4. Use of artificial intelligence systems

Julian Fashion uses artificial intelligence (hereinafter “AI”) tools to support some of its Services. In accordance with Regulation (EU) 2024/1689 (the “AI Act”) and Italian Law no. 132 of 23 September 2025, we provide below, in clear and simple language, information on how they are used.

a) Chat virtual assistant

The customer service chat on the Site is handled, in the first instance, by an AI-based virtual assistant and not by a person. You are informed of this when the conversation opens, where the other party is identified as “AI Assistant”. You can ask for a human agent to step in at any time: the request is taken over by our customer service, which replies to you by email. The assistant answers the most frequently asked questions (for example about products, sizes, availability, order status, shipping and returns) by processing the text of the messages you write and, where needed to reply, information relating to your orders.

What you should know:

  • Purpose and legal basis: the data are processed to respond to your support requests (purpose referred to in section 3, letter a); the use of AI serves no further purpose. Conversations are not used to send you promotional communications or for profiling purposes, unless you have given specific consent as indicated in section 3, letters c) and d).
  • Data processed: the content of the conversation, any identification and contact data you provide, data relating to the orders consulted in order to reply, and technical session data.
  • Human intervention: you can ask at any time for an agent from our customer service to step in, who will reply to you by email; more complex requests, or those not resolved by the virtual assistant, are handled by Julian Fashion staff.
  • No automated decisions: the virtual assistant does not take decisions that produce legal effects concerning you (for example on accepting a return or refund); such decisions always remain with the Controller’s staff.
  • Limits and risks: AI-generated answers may occasionally be inaccurate or incomplete; for binding information (for example terms of sale, withdrawal periods, refund amounts), the General Terms and Conditions of Sale and communications from customer service prevail. Please do not enter in the chat any data not needed for your request, in particular payment data or special categories of data.
  • Providers: the chat service is provided by a technology provider appointed as data processor, which uses AI models supplied by sub-processors contractually bound to comply with data protection law. The content of conversations is not used to train third-party providers’ AI models. The service provider may derive information from the data in aggregate form, which does not allow you to be identified, to improve its services. The service involves a transfer of data to the United States, under the safeguards described in section 6.
  • Attachments: please send through the chat only files and images needed for your request, avoiding identity documents or other documents containing irrelevant data.
  • Opting out: if you prefer not to interact with the virtual assistant, you can contact us through the contact form, by email or via WhatsApp, and receive a reply directly from the Controller’s staff.

b) Content created with the support of AI

Some product images (including images of garments worn by models) and some descriptive texts on the Site may be created or enhanced with the support of AI tools. All content produced in this way is reviewed and approved by Julian Fashion staff to ensure it is consistent with the actual characteristics of the products. This activity does not involve the processing of your Personal Data. More information is available on the “AI” page, which can be reached from the Site’s footer.

5. Recipients

Your Personal Data may be disclosed to the persons or categories of persons indicated below, solely for the purposes described above:

  • a) persons authorised to process the data by the Controller, who have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality (for example staff working in customer service, e-commerce, logistics, administration and human resources);
  • b) third parties appointed as data processors pursuant to Article 28 of the Regulation, who process the Data on behalf of the Controller, such as: the provider of the Site’s e-commerce and hosting platform; the providers of the platforms for sending email communications and for managing customer service, including the chat with virtual assistant; providers of analytics and cookie consent management services; providers of IT and maintenance services;
  • c) third parties acting as independent controllers with whom it is necessary to interact in order to provide the Services, such as couriers and shipping companies, banks and payment service providers (including digital wallets and instalment payment services), the international sales partner referred to in section 2, letter b), with which Julian Fashion also acts as joint controller for the processing described there, Shopify for services relating to the Shop account and for advanced platform features for which it acts as independent controller, as well as advertising partners for third-party cookies, as indicated in the Cookie Policy;
  • d) consultants and professionals (for example legal and tax advisers) for compliance with legal obligations or the protection of the Controller’s rights;
  • e) persons, bodies or Authorities to which your Data must be disclosed under provisions of law or orders of the Authorities.

The up-to-date list of data processors can be requested from the Controller at the address indicated in section 1. Your Personal Data will not be disseminated.

With regard to the Shopify features for which Shopify acts as independent controller, you can consult Shopify’s consumer privacy policy at https://www.shopify.com/it/legal/privacy/consumers and exercise the related rights through the portal https://privacy.shopify.com.

6. Data transfers outside the European Economic Area

Some of the providers used by the Controller are based, or use infrastructure, outside the European Economic Area (in particular in the United States and Canada). In such cases, the Controller ensures that the transfer takes place in compliance with Chapter V of the Regulation, on the basis of an adequacy decision of the European Commission (for example, for the United States, the recipient’s participation in the EU-U.S. Data Privacy Framework) or, failing that, of the Standard Contractual Clauses approved by the European Commission, supplemented where necessary by additional measures. You can obtain more information on the safeguards adopted by writing to the address indicated in section 1.

8. Rights of the data subject

As a data subject, you have the right to obtain from Julian Fashion, where applicable, access to your Personal Data, their rectification or erasure, restriction of processing, portability of the data you have provided to us, and to object to processing (Articles 15-22 of the Regulation). In particular, you can object at any time to processing based on the Controller’s legitimate interest on grounds relating to your particular situation and, without giving reasons, to processing for soft spam purposes.

You can also withdraw at any time the consent given for marketing and profiling purposes, without affecting the lawfulness of processing carried out before withdrawal. You can also stop receiving promotional communications by using the unsubscribe link at the bottom of each email or by managing your preferences in your account.

You can change your choices regarding profiling and third-party cookies at any time through the “Privacy settings” link in the Site’s footer.

If you are registered, you can update your data yourself by logging in to the reserved area of your account. Requests to exercise your rights can preferably be submitted by email to privacy@julian-fashion.com, or by post to the Controller’s registered office indicated in section 1. The Controller will respond without undue delay and, in any case, within one month of receiving the request, which may be extended by two months in the cases provided for by Article 12 of the Regulation; in order to process the request, it may be necessary to verify your identity.

If you believe that the processing of your Personal Data infringes the Regulation, you have the right to lodge a complaint with the Garante per la protezione dei dati personali (the Italian Data Protection Authority, www.garanteprivacy.it), as provided for by Article 77 of the Regulation, or with the supervisory authority of the Member State in which you habitually reside or work, or to take legal action before the competent courts (Article 79 of the Regulation).

9. Minors

The purchasing Services offered through the Site are reserved for persons of legal age. Julian Fashion does not knowingly collect data from minors under the age of eighteen. If a parent or a person exercising parental responsibility becomes aware that a minor has provided us with their Personal Data, they may contact us at the address indicated in section 1 to request their deletion.

10. Updates and changes

The Controller reserves the right to amend, supplement or periodically update this notice, including in compliance with applicable legislation or measures adopted by the Garante per la protezione dei dati personali (Italian Data Protection Authority). Changes will be published on this page with the date of the last update; in the event of substantial changes, you will be informed by appropriate means.
